Enforcement of Foreign Judgments

Our clients often obtain judgments via state courts outside of North Carolina.  Our state follows a straight forward procedure to domesticate these foreign judgment to our jurisdiction.  The Uniform Enforcement of Foreign Judgments Act provides the specific statutory requirements.  Most of the time judgment debtors ignore the paperwork, and the judgment becomes valid in our state without a court hearing.  However, a judgment debtor holds the ability to challenge the jurisdiction of a foreign judgment.  Once in a while, judgment debtors schedule these types of proceedings such that it is very important to keep documented proof of why a North Carolina party availed themselves of the jurisdiction of an out of state court.map
