WAGE GARNISHMENT COMING TO NC???

Senate Bill 632, introduced on March 26, 2015, may pave the way for judgment creditors in North Carolina to garnish the wages of a judgment debtor.  Currently, wage garnishment is only permitted in North Carolina in extremely limited circumstances.  However, if Senate Bill 632 becomes law, a judgment creditor would be able to petition the Clerk of Court for a Writ of Garnishment which would then be served on the employer of the judgment debtor, for the purpose of garnishing the judgment debtor’s wages in order to satisfy the judgment.  This would constitute a significant shift in debtor-creditor law in North Carolina.  On March 30, 2015, Senate Bill 632 was referred to the Committee on Rules and Operations of the Senate.  Continue to monitor Senate Bill 632 as it makes its way through the North Carolina General Assembly.
